APPLICATION FOR DAMAGES AND A TICKET REFUND FOR DENYING MY
FAMILY TO TRAVEL FROM GHANA TO CANADA ON DECEMBER 6, 2019
First, I wish to express my dissatisfaction and disappointment in Egypt Air for refusing my family boarding of Flight MS882 from Accra Ghana to Cairo Egypt on a very flimsy reason without any merit.
My family was supposed to travel from Accra to Cairo on flight MS882, from Cairo to Toronto on flight MS995 and from Toronto to Saskatoon on flight AC1121. They reported for check-in almost three hours early, had all their valid documents (valid passports, visas, and ticket reservation with Egypt Air).
Nonetheless, they were refused boarding by the front desk check-in agent on grounds that my family was travelling on a one-way ticket. The lady claimed that my children who were minors (ages 7.4 and 3.9 years) and were travelling on a visitor’s visa ought to have had a returned ticket. My wife called me and explained to the agent that children at their ages are mostly issues visitors’ visa and at the port of entry in Canada, they will be issued visitors’ record which allows them the same duration of stay in Canada as their parents.
So, this was not an immigration issue nor Egypt air policy. If It was the airline policy, I would have been notified about that at the time of purchasing the ticket. In any case, Ethiopian air and many other airlines do not see this as a case, since it is not an immigration rule that children travelling to Canada on a visitor’s visa must have a returned ticket. If Immigration Canada had an issue with my children coming to Canada or had had any doubts that the children will not return to Ghana, they would have requested that I provide them with a returned ticket for my children. Since this was the case, I felt that Egypt air had acted as an immigration body rather than an airline.
My children and family rights to have a safe and convenient flight was violated without any genuine reason based on security, safety or otherwise. The refusal of Egypt air to allow my family travel on a ticket they had appropriately acquired has caused the family so much emotional and physical trauma. My wife is devasted severely and the entire family is experiencing financial, time, and emotional lost and pain. We think that the refusal of Egypt air to allow my family board the flight was unnecessary and a violation of my children right to live with their parents.
We have resolved that Egypt should, as a matter of urgency, acquire tickets for my family and to fly them to Saskatoon latest by December 12, 2019. We are also asking for damages to an amount deemed appropriate for the emotional pains and traumas caused and for denying my children the right to live with their parents and my wife to reconnect with her husband. If these demands are not met by the set date, we will resort to the international media with this issue and engage with the appropriate international and Canadian legal institutions and human rights non-governmental organizations to ensure that we get justice as a family.
Find attached the ticket reservation for which my family was refused to travel on. And further note that there was no problem with the booking nor with any travel documents my family had.
